LingoLearn - Terms of Use and Site Regulations

LingoLearn.com is an Internet site that teaches languages online. The site provides teachers and students with an online teaching platform.

All lessons are performed as live video conferences, and all that entails.

The following terms govern access and use of the site. Accessing or using the website constitutes consent to these terms of use, and/or to updated terms of use. If you do not accept these terms of use, please cease from using the site immediately.

These terms of use are subject to the orders of the sales contract. In any case of inconsistency between the purchase agreement and these terms of use, the terms and stipulations of the sales contract will prevail.

General

1. Use of the site is subject to licensing by the site administrators. On registration to the site, the user may receive a personal user name and password, which will serve him while using the site. The user is requested not to pass on his username and/or password to anybody else.

2. If the user decides to purchase a package of lessons from the site, the purchase will be subject to the consumer protection law in Israel regarding remote sales transactions. The user is hereby informed that he may annul the purchase within 14 days, by informing the site of his intention to do so in writing.

3. The user will use the site only for purposes specifically authorized by the site administrators. The user is obligated in particular to refrain from using the site in any illegal manner, including uploading of offensive materials, sexual harassment, making libelous and/or defamatory and/or slanderous statements about the site and/or any one of its managers and/or users and/or any other third party; and any other use not specifically authorized by the site manager.

4. The user is required to use clean language during the online lessons. •In any case, the site managers will not be responsible for misuse of the site, or for any harm caused to the user, or other users, as a result of such misuse.

5. The site managers aim to ensure that uploaded materials are updated, correct and are suitable to the curriculum. Nevertheless, the site managers are not responsible, nor can they guarantee their accuracy. Using the materials is solely at the risk of the user. The user herby declares that he is aware that the materials taught might be inaccurate and that the site and/or its managers will not be held responsible for any damage caused to the user, as a result of any such inaccuracies.

6. The user acknowledges that he is aware of the fact that the site managers are unable to supervise all online (live) lessons and therefore will not be held responsible for what is said or taught during the lessons. Without limiting the generality of the foregoing, the client is aware that some of the lessons will be monitored for purposes of quality control.

7. The user hereby gives his consent to the site, to send invitations to lessons and/or marketing material, to the email address given during registration. If the user is not interested in receiving such materials, this will be indicated in the relevant place in the sales contract.

8. The site managers retain the right to make changes in the site and in the terms of use, at any time and for any reason, without prior notice. The user hereby accepts this.

9. The user declares that he will use the site in accordance with the terms of use that will be published from time to time.

10. The user acknowledges the fact that the materials on the site are the exclusive intellectual property of the site managers and that they are not to be copied, published, distributed, or otherwise used in any way, without the prior consent of the site managers in writing.

11. Illegal use of the site and/or use that violates the terms of use of the site will lead to the user being blocked from using the site, without refund. The user hereby waives any claims in advance in this matter.

12. The user agrees to indemnify the site and/or its managers for any damage or loss incurred, as a result of improper and/or illegal use.

13. Transfer of services from the user to a third party is prohibited, without the express consent in writing of the site.

Lesson packages

14. The site will offer from time to time, private lessons packages and/or courses in different languages. The site may change, according to its managers' own judgment and discretion, the packages, their quantity, price and the teachers who teach the lessons.

It is hereby explicitly clarified that the site is not committed to provide the student with any certain teacher, but only the amount of lessons ordered, as well as the language and level ordered.

15. The lessons will generally last one hour (60 minutes).

16. After purchasing a package of lessons, a technical test will be scheduled. It is hereby clarified that if the technical test shows that there are no outstanding technical issues or problems, the user will not be able to make claims dealing with technical problems with equipment in the future.

17. During the purchase of a package of lessons, a permanent time will be scheduled for the lessons (weekly day and hour); and a final date for completing the package, which will take into consideration the number of lessons purchased, together with an additional 50%, in order to allow for lesson postponements.

18. A link to the virtual classroom will be sent to the user approx. 10 minutes before the lesson begins.

The Client is hereby kindly requested to arrive on time to the lessons. It is hereby explicitly clarified that if the user fails to show up on time, the lesson will not be made up, and the lesson will begin when the user enters the class.

Without limiting the above mentioned terms, it is hereby clarified that the lesson will be cancelled if the user arrives 20 minutes after the scheduled beginning of the lesson, and in such cases the teacher is instructed to leave the class and the user will be charged for the lesson.

Lesson postponement, cancellation and non-arrival

19. The user may request to postpone private lessons in advance.

Group courses can not be postponed, unless there is agreement between all the students and the teacher, as to the postponement.

20. If the user does not show up for a class that is part of a group course, the lesson will not be refunded or made up. It will be the user's responsibility to make up the material learned in that lesson. The site will provide the user with materials taught during the class.

21. The following terms and stipulations apply in the case of a package of private lessons:

a. If the user cancels a lesson at least 24 hours in advance, the lesson will be made up. Whenever possible, the make up lesson will be held in the same week; if this is not possible, the completion date of the course will be postponed by one week. This however will be done in accordance with the above mentioned final date for completion of the course.

b. If the user cancels a lesson less than 24 hours in advance, the lesson will not be made up and the user will be charged for it. Nevertheless, the site may, according to its own discretion, make up the lesson. It is hereby clarified that this clause by no way obligates the site to make up a lesson cancelled less than 24 hours in advance.

c. In any case, if the user cancels a lesson less than three hours in advance, or fails to show up for a lesson, without prior cancelation, the lesson will not be made up and the user will be charged for it.

22. In the case of cancellation for reasons that are beyond the control of the student (site collapse, falling of servers, other technical problems on the part of the site or the teacher, etc.), a make up lesson will be scheduled for the same week and if this is not possible, the course completion date will be postponed by one week.

23. The student is responsible for the proper functioning of his technical equipment (computer, internet connection, microphone and earphones) and it is his responsibility to make sure that his equipment is functioning properly before each lesson. In the case of a technical problem with the above-mentioned equipment, the student will notify the site about the problem, as soon as possible and try to locate alternative equipment. It is hereby clarified that a lesson that is cancelled or interrupted, due to technical difficulties on the part of the student, will not be refunded or made up.

Costs and prices, refund policy

24. While purchasing the package of lessons, the price of the package will be determined (hereinafter: "the price of the package").

25. The user acknowledges that the price of the package is a special price for a package of lessons, and that the price for a single lesson is 1.5 times the price of the package, divided by the number of lessons in the package.

26. The price of the package includes a registration fee (covering expenses related to opening a class and preparation of teaching materials) which constitute 5% of the price of the package. This registration fee is non-refundable in case of contract termination.

27. Contract termination:

This contract is subject to the provisions set forward in the consumer protection law in Israel, regarding termination of remote sales transactions. The following are the details of the relevant provisions, without limiting the generality of the foregoing:

a. Cancellation within 14 days of the transaction

The user may cancel the purchase, within 14 days of the transaction, for any reason. Notification of such a cancellation will be done in writing. Within the 14 day period, no cancellation fee will be imposed on the user and the full payment will be refunded, after deduction of the 5% registration fee.

For purposes of clarification, the user will be charged for any lessons that take place within the 14 day period, prior to cancellation. The price of every lesson will be calculated according to the price of a single lesson; that is to say 1.5 times the price of a lesson in the package (which is a special price for the package, as mentioned above).

b. Cancellation after the 14 day period

The user may cancel the transaction after the initial 14 day period, as well.

In such a case, the user will pay an agreed upon cancellation fee of 50% of the total price of the course.

The user hereby authorizes the site to deduct the cancellation fee from the total due refund.

In any case of transaction cancellation, as stated above, the user will receive the refund, according to the above mentioned terms, within 21 working days, from the date of receiving notification of the cancellation in writing, at the designated address of the company.

"The user" in these terms of use: a registered student. The terms of use will also apply, with the required modifications, to an unregistered student and a chance visitor on the site.
